Ashley Sale Signage Protected by Bankruptcy

Furniture sales giant Ashley Furniture, currently in bankruptcy, is posting large sale signs in violation of local signage laws, but town officials are unable to stop them.

A federal bankruptcy court in Florida recently issued an order giving the store wide latitude in posting signage related to the bankruptcy sale, even if they violate local laws, which is the case here.

"Except as expressly provided for in this order with regards to Ashley HomeStore, the Debtor may advertise the Sale through media advertisements, interior banners, exterior banners, and other signage including street signage and sign walkers as Debtor and PRP deem appropriate, NOTHWITHSTANDING ANY PROHIBITIONS IN ANY FEDERAL, STATE, COUNTY, OR LOCAL STATUTES, ZONING RULES OR ORDINANCES AFFECTING ADVERTISING AND PLACEMENT OF SIGNS," the court ruling states.

The ruling is in effect until March 30.

An effort by town officials to issue fines for the signage violations was rebuffed.
